Amended Complaint filed in Grant v. Harris

 

On April 24, 2025, Plaintiffs Marc Grant, CJT, and Daniel Gray and new Plaintiff Dina Portillo filed an amended complaint in Grant v. Harris, Case No. 4:24-cv-384-RH-MAF. Plaintiffs are four adults with significant disabilities who are enrolled in Florida’s Statewide Medicaid Managed Care Long-Term Care Program (known as the “LTC Waiver”) where they receive medically necessary home and community-based services that enable them to live at home and access the community rather than residing in an institutional setting. All Plaintiffs have family members or friends who have provided unpaid voluntary care (known as “natural supports”) for at least some of their critical care needs. The Second Amended Complaint focuses on AHCA's failure to develop uniform policies, rules, regulations, or training to guide the collection and use of information about the availability and ability of natural support to provide unpaid voluntary care. Without uniform standards, Plans made decisions to deny, reduce, or terminate services in reliance on natural supports that are not able or available to provide care, placing LTC Waiver enrollees like Plaintiffs at risk of institutionalization.
